Terms of Service

1. Acceptance of Terms

By accessing or using Averium ("Service"), provided by Averium Technologies Inc. ("Averium", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Averium is a 3-in-1 email platform for startups, combining a transactional email API, bulk broadcast campaigns, and email automation sequences in a single product.

3. Account Registration

You must sign in with a valid Google account to use the Service. You are responsible for safeguarding your credentials and for all activity that occurs under your account.

4. Acceptable Use

You may not use Averium to send spam or unsolicited email, distribute illegal content, conduct phishing, or otherwise misuse the Service. Violations may result in immediate account termination without refund.

5. Email Sending Policy

You are solely responsible for maintaining valid recipient consent and for complying with all applicable laws, including CAN-SPAM, GDPR, CASL, and other regional anti-spam and privacy regulations.

6. Payments & Billing

Paid subscriptions are billed via Stripe. All fees are non-refundable except where required by applicable law. You authorize us to charge your payment method on a recurring basis until you cancel.

7. Service Availability

We aim to provide high uptime but do not guarantee uninterrupted or error-free service. We are not liable for delivery failures caused by factors outside our reasonable control, including recipient mail servers, ISPs, or third-party providers.

8. Intellectual Property

Averium and all content, software, and trademarks associated with the Service are owned by Averium Technologies Inc. Your data remains yours; we only process it to provide the Service.

9. Termination

We may suspend or terminate accounts that violate these terms or pose a risk to the Service or other users. You may cancel your account at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Averium is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
